So Jessie maintained his guilt long after he was no longer in the custody of the WMPD

Jessie Misskelley Sr. had become something of a pain. Every time Dan and Greg turned on the news, there was "Big Jessie" talking to the press, telling them a story about his son having been wrestling fifty miles away in Dyess, Arkansas, when the murders were committed. And yet Little Jessie kept telling Dan the story he'd told the police. Dan figured the father was just in denial.

Not only did he maintain his quilt, but Stidham himself believed Jessie was guilty.

So when did he change his mind?

Ron Lax approached Dan and Greg and asked if they wanted to have lunch. Lax, a private investigator from Nashville, Tennessee, had been working for Damien's attorneys. Lax "has strong feelings about the death penalty," Stidham says.

During lunch, Lax said, "Have you ever heard of Dr. Richard Ofshe?"


There's a fucking surprise, huh?

On a cold December day, Dan met Ofshe face to face in Paragould. He looked like a professor--bushy gray hair, bushy gray beard. But his voice was soft and soothing. They drove together through the delta to the jail where Misskelley was housed. Dan introduced them and left them alone.

Nervously, he waited. And waited. And waited some more. After four hours, Ofshe emerged from the interview. They got in the car for the drive back to Paragould. Dan held himself in as long as he could, but a couple of blocks from the jail he blurted it out: "Well?"

Ofshe smiled at him. "He's innocent," he said.


I don't have to remind anyone what a documented fraud Ofshe is, do I?

And Stidham is the source for the film makers "facts"?

Before I do that lets see who Cassell is:


This weekend I saw that the Professor who taught me Criminal Law and Criminal Procedure is leaving from the bench already, after only five years in the federal judiciary. No one will disagree with me that he is a brilliant, ethical, and fair man. Moreover, even though he was only a district court judge in Utah (and the youngest federal judge ever from that state at 42), he was highly influential.



The guilty and the "innocent':
An examination of alleged cases of wrongful conviction from false confessions

[5. Jessie Misskelley

In 1994, Jessie Misskelley was found guilty of participating in the murder of three eight-year-old boys - Steven Branch, Christopher Byers, and Michael Moore. Police interviewed Misskelley about a month after the boys were found dead in a creek-tied up, beaten, and mutilated. Although Leo and Ofshe assert the confession was "inconsistent with the facts of the case," it was in fact proven beyond a reasonable doubt to be consistent in its most important respect - the identity of the main killers.

About a month after the gruesome murders, police asked Misskelley to come to the station house in order to answer some questions. Misskelley admitted that he watched as two of his friends-Damien Echols and Jason Baldwin-beat and abused the young boys, and that he (Misskelley) kept one of the boys (Michael Moore) from escaping. Based on this incriminating statement, police arrested Echols and Baldwin as principals in the murders and Misskelley as their accomplice. The accuracy of Misskelley's identification of Baldwin and Echols as the killers was established by guilty verdicts at a separate trial resting entirely on independent evidence, because Misskelley's confession could not be used as evidence at that trial. That independent evidence included clothing fibers found on the victims' clothes that were microscopically indistinguishable from items found in the Baldwin and Echols residences, and from various witnesses who heard Echols and Baldwin admit committing the crimes. The capital sentencing phase also included grisly testimony from a defense psychiatric expert who said Echols believed, among other things, drinking blood of others gave him special powers.

At Misskelley's trial, the prosecution acknowledged some discrepancies between Misskelley's confession and the crime scene, but identified a number of consistencies knowable only by someone with first-hand knowledge of the crime. These details included not only correctly identifying Echols and Baldwin as the killers, but also the following:

Misskelley confessed that, when he left the scene, the Byers boy was already dead on the ground; there was evidence that the creek contributed to the deaths of the other two boys, but not the Byers boy. 

Misskelley confessed that the Byers boy was cut on his penis; the Byers boy was the only boy found with severe genital mutilations.

Misskelley confessed that one of the boys was cut on the face; one of the boys had facial lacerations.

Leo and Ofshe also report that "numerous" witnesses placed Misskelley at a wrestling competition forty miles from the crime scene. This wrestling alibi would, in the colorful phrase of reporters covering the trial, be "pinned for the count." Two of the alibi witnesses had previously given statements to the police that they were unaware of Misskelley's whereabouts on the night of the murder. According to the reporters, the prior statements "destroyed any credible
Misskelley alibi." In any event, at trial, the defense fully explored all of the issues. Although Misskelley did not take the stand, his attorneys presented extended testimony from an expert, none other than Richard Ofshe, about the alleged false confession. The jury nevertheless convicted Misskelley, and nothing in Leo and Ofshe's account suggests that any significant relevant evidence was kept from them.

Developments since Misskelley's trial, not discussed by Leo and Ofshe, strongly confirm the verdict's accuracy. After his conviction, Misskelley confessed two more times. On the drive to the state prison, after he was assured that nothing he said could be used against him, Misskelley gave a detailed statement about the crime. Prosecutors then arranged for a judicially-approved interview of Misskelley, over the strenuous objections of his defense attorneys. In the forty-minute recorded interview, Misskelley provided details about the crime. Misskelley said that, when he got off work at dinnertime, he went to a wooded area with his friends Echols and Baldwin. When three boys entered the woods, Echols jumped them. When they resisted, he (Misskelley) and Baldwin had entered the fray. Misskelley grabbed the one with the blue boy scout uniform (Michael Moore) to prevent his escape. To keep him under control, Misskelley hit him repeatedly on the head. Misskelley then watched as one of the other boys was cut on the penis, recounting that "I seen blood fly."* Misskelley also explained how the boys were tied up with shoelaces from their shoes. When first questioned by police, he had said that the boys were tied up with rope to throw the police "off track." Misskelley left before Echols and Baldwin, carrying with him a bottle of whiskey, which he busted under a highway overpass close to the woods. Prosecutors and defense counsel went to the overpass and found a broken bottle at the indicated location. The broken bottle neck matched a bottle of Evan Williams Kentucky Bourbon, the kind Misskelley said he drank the day of the murders.

The above is from a Federal Judge.... The WM3 are finished.




Basically Ofshe and Leo are basically reduced to being full of shit only he does in so much more powerful wording that is so complete that there is nothing left to consider about Ofshe and his theories. They are totally OWNED by former Federal Judge and Professor of Law Cassell.

Interesting stuff. It's funny how supporters think the judges are stupid for believing the confessions when only an idiot could believe that someone would make false confessions a year apart and after conviction. Alright, Misskelly was stupid, but that stupid? It's inconceivable.

Only an idiot would come here posting with the insistence that the confession is consistent!
Any decent judge would take one look at that confession and realize whether the kid was in fact guilty or not, the statement was completely cooked up by the interviewing officers. Anyone that commits or witnesses a crime so vulgar doesn't have such scattered and inconsistent statements. You're also dealing with a kid in the 9th grade that has heard more stories about these murders in the first few hours it spread around town than we all will combined, in our entire lifetime.

He may have witnessed the crime but I very seriously doubt it with the scatter brained, inconsistent statements he makes. He repeats over and over again how he ran off. Meanwhile the cops keep returning him to the scene of the crime AFTER having run off, he then agrees to their further accusations then insists he ran off again.
Based on that confession, he ran away a good 4 times but not once, NOT ONCE does he say he returned aside from the statement where he returned the boy that escaped.

I'm almost inclined to believe the entire story has been staged, the crime scene photos are fake and the public is being taken for a ride by the powers that be. It sure as hell wouldn't be the first time and the whole concept that numerous, well educated adults were repeatedly this incompetent and flat out stupid?
It's a tough sell for me.  Now why would anyone or any group fake something so horrific?
If you need me to answer that, you wouldn't believe my answer anyway nor would you truly understand it...

No dumbass, hoax meaning these kids weren't really thrown in prison as in, NONE OF IT WAS REAL.
Meanwhile they can gauge society in countless ways based on the reactions. Try building a morality profile of your citizens, you need some type of very public conflict and who would you incorporate to stage it?

 Seems to me like you'e having delusional episodes. How can you know the ignorance of ANYONE commenting about this case, when every single reply that you have made proves beyond the shadow of a doubt that you have never bothered to spend more than 10 minutes reading through the documenttion available.....do you even know where it is???

 Have you ever stood AT THE SITE of the murders?? Have you ever been INSIDE the evidence room of the WMPD?? Have you ever met ANY of the persons affected by this tragedy?? Your childish & mindless rambling shows that you haven't. And you are trying to argue with people that HAVE!?!? Ha....good luck. Until you can actually learn to discuss the case with the adults that are on this site, in an adult-level conversation, then I doubt very seriously if any of your random gibberish will be taken as anything more than humoristic filler material.
