 Why didn't all three get the death penalty? Was it just Damien's blowing kisses and attitude throughout the trial?
 
Also....Damien was receiving SSI disability benefits before the trial,now with him being a prisoner and whatnot,is there a law either state or federal that can take away his disability checks and medical? Or does he still get a check in his commisary fund?

Also one more thing,does anybody here think that Jessie had felt remorse in the least bit for what he had done? I had read a few things on callahan's suggesting he had,and I think maybe he wanted to admit at trial and testify but when the whole innocent BS came into play I dont think he could bring himself to tell his family what he had really done.

Jason and Jessie were not 18 at the time.

I don't know about Arkansas, but in MD your disability and medical get cut off if you get incarcerated.

Thanks kerriew. As you can tell I'm not a lawyer or even know the laws that well.

Now I know for a fact I read that Damien took (abused more like it) a migraine medication called epidrin (midrin).

Now seeing as how he was diagnosed with chronic migrains at a very young age and it being a controlled substance,he wouldn't be able to get that in prison would he?

Atleast that's what I hear,no controlled substances such as pain killers,anxiety,sedatives,etc for prisoners,but what about a prisoner diagnosed with let's say pancreatic cancer,which is painful.....I know they go to a medical ward but they don't get pain releif do they?

I totally agree with you all also. I really dont think Damien can get his SSI now that he is incarcerated. I get disability, and one of the first things they asked me was if I was ever convicted of a felony. I dont know for sure, but Im guessing he lost that when he was convicted. Im hoping too. LOL  also, the midrin he was taking. Im totally not trying to defend him at all, and im kicking myself for putting this, but I want things to stay honest and forthright, dont wanna be anything like the crap over on the other board. Butttt  I take midrin for migraines. It is not a narcotic at all, and it is written to take 2 pills on the onset of the migraine, and one after ever 1/2 hour of pain, up to 5 pills. I only need the first 2 and Im good with my migraine, but I dont think he could be abusing it for any "high" reason. I could be wrong, he couldve been taking all kinds of midrin, but I wouldnt understand why. It doesnt make you high, or feel weird. At least not for me, it didnt make me feel any different, except to take away the visual stuff and the pain. Maybe if he took enough of them, it made him get high  LOL  who knows with him. But I just wanted to throw that out there.  I totally could be wrong.  ;D

I also take midrin as well and I can say for a fact it can get you high if you take 6 or 8 at once lol.

It has a sedative in it and it is a schedule 4 drug.....atleast that's what I've read.

But the thing is,if he had migraines that bad how could he take it in prison? Maybe he was faking it,who knows?

I'm not defending him either but if they have to provide him medication for bi-polar,manic depression,and God knows what else.....don't they have to dispense something for migraines? Excedrin lol?

I am going to throw my "I thinks" out there.

Damiens SSI ceased as soon as he was incarcerated.  It will remain ceased as long as he is incarcerated.

Prisons have a pharmacy and I 'think' that if the prison physician or APN prescribes a drug for him, he is entitled to it.

And I 'think' that as Jessie said 'he wanted something done about it' when he confessed in Calvins office in front of his counsel, against their request to do so.............he had remorse of the events.  I also 'think' that when he stated that Jason called him and could hear Damien in the background yelling 'we did it, we did it' that perhaps he did leave the scene, with strong feelings that the children were dead, but perhaps he did have some hopes that they were not.   When he received this phonecall though, those thoughts were laid to rest, he then would have known that they were all dead.  Don't get me wrong, I think that Jessie is a monster also...........but IMO he showed remorse.  "I think' that is the whole reason as to why he confessed.  Remember it was stated that he had horrible nightmares afterwards?  Who knows, he is horrible too, but when the killing frenzy began, he himself may have been too scared and afraid to stand up for what was right in fear that they would hurt or kill him too.  My impression is that Damien was feared by most and he and Jessie were not heavy acquaintances anyway and he probably had a fear of him too.  If he had turned against him during this masacre, it is highly likely that he would have been murdered also to keep him quiet.  That is all just my little opinion though.

I kind of enjoy it because now even after I die people are going to remember me forever. They're going to talk about me for years, People in West Memphis will tell their kids stories. It will be like, sort of like I'm the West Memphis boogeyman. Little kids will be looking under their beds~Damien E.

 Wow  I didnt know Midrin was like that. I never took more then 3 pills, and it never made me high or anything. See, I said I could be wrong LOL  It happens all the time.  ;D  I dont know the particular classes for the medications. I couldve sworn it wasnt narcotic though. It was the first migraine med to actually work for me. A friend turned me onto it at work, it worked wonders, so i asked my doc if I could have a rx.

I'm waiting for this as well.Too bad it's just a needle and not the gas chamber or firing squad like the good ol' days,ya know before the hippies came around and thought about how the murders shouldn't suffer even though their victims more than likely screamed in terror the whole time.


Shouldn't his death warrant be signed pretty soon anyways? I hope this doesn't turn into a Tookie Williams thing where it takes 22 years or whatever.


Kinda defeats the purpose of a death sentence if the victim's family doesn't live long enough to see it.
