Here's what I think happened:

1) Stidham and Jessie plan on entering a guilty plea and getting a deal to testify against the other two.
2) HBO notifies everyone a film crew is coming to make a movie.
3) Stidham wonders how he can be in the movie, because if his client enters a guilty plea he won't get any camera time.  Maybe the confession is false?  He talks to Ofshe, mentions HBO, and Ofshe is on board..
4) Ofshe and Stidham tell Jessie their tests show he was falsely testifying.  Stidham tells Jessie he might get off because there is no physical evidence against him and the confession is bogus.  Jessie decides that's a good way to go because he wasn't fond of people thinking he's a child killer anyway.  Plus jail is no fun.
5) Jessie tries his best to score poorly on the mental evaluation tests, after coaching by Stidham. But he still falls short of retard status.
6) Jessie is convicted.  Life plus 40.  He has enough basic math skills to immediately realize he should've took a deal and plead guilty.
7) Jessie starts talking again - to the cops, to his attorneys, to the prosecutors -- he wants something done about it. 
Stidham turns white and does not know what to do, because he has screwed his client and might look like a total fool in the movie.  Luckily, this part never makes it past the editing room.
9) Jessie's mom and dad tell him they won't be able to look at him if he gets up on that stand and lies.
10) Jessie does not testify against Echols and Baldwin - he'd rather his family continue to convince themselves he's innocent.
11) Various news outlets and media sources report the case and run shows on the case.  None of them ever ask Jessie the hard questions.  He tattoos a clock on his head.

That's the only one I have issue with.

I think Wells advice played as big a role in Jessie's refusal to testify than any sense of pride.

I think It was legally better for Misskelley to wait and see how the verdicts turned out.

If E/B were found not guilty, then Misskelley lost nor gained nothing with his testimony

But were there convictions, Misskelley stood a better chance of gaining early release from the parole board were there eventual retrials to which he would testify.

In fact, I can see absolutley no reason for Misskelley's falure to take the stand in his defense last year except for the future possibility of him turning state's evidence in a potential future retrial of E/B.

If Jessie was 6 or 7 years old and came up with the same story after being interrogated by the police without an attorney or parent....would you think the story was correct?

Do you think Aaron Hutcheson was telling the truth? Aaron was older than the mental age of Jessie at the time.
Jessie didn't even know that Stidham was working on his behalf.

I'm currently reading "Case closed" about the Kennedy assasination (more about the conspiracy theorists than anything else, actually)

In it Garrison get's completly shredded with documented fact, and Stone's film JFK comes off worse that even PL2.

I'm still not convinced Oswald acted alone, but there is absolutely no question in my mind that Jim Garrison is a crimiinal and a fraud - it's incredible just how much shit the man flat out made up. (for example, There are transcripts of him doing the rounds on the talk shows, and his nonsense COMPLETLY changes from show to show)

Anyway, to me the most interesting parts are the authors observations regarding the psychology behind those who "need" to believe Garrison and his ilk.

Paid mentioned Jessie being retarded again so I just happen to have the DSM IV sitting in front of me on my desk and I looked the criteria for mental retardation.

pg 42: Mild MR IQ 50-55 to approximately 70
Moderate MR IQ- 35-40 to 50-55
Severe MR IQ-20-25 to 35-40
Profound MR IQ level below 20 or 25

pg 41 Subaverage intelligence functioning is defined as an IQ of about 70 or below (approximately 2 standard deviations below the mean)
Measurement error of approximately 5 points in asssessing IQ.
There is also different scales for measuring intelligence. Wechsler IQ, Stanford-Binet and Kaufman Assessment Batttery for Children.
Anyone know which one Jessie was tested with?

PG 42 If a person has an IQ of 70 or below without any adaptive functioning impairments, then no dx of mental retardation is given. These would include problems dressing, bathing and feeding self, not being able to understand language, or not being able to socially function with peers and family.
Jessie did not have any impairments of adaptive functioning. He does not fit the DSM-IV criteria for even mild mental retardation and stupidity is not a dx

I still chuckle at the fact that supporters constantly whine about transcripts of those four hours Misskelley was with his interrogators, yet they couldn't care less about the four hours he was with Ofshe.

Especially when we have documented proof of Ofshe coaching a confessed defendant into pleading not guilty and claiming they were coerced.
