Apologies if this is already posted somewhere, I can't find it if it is: I am wondering when Echols gets the needle? Supporters are saying he now has a shot at appeals at Federal level. When does time really run out for him?

I am willing to wager that Echol's federal habeas corpus claim will be denied without a hearing, just as his state claim was.

It fails on any number of levels.

First off, it hinges on the DNA results - which since they have now been presented in State court - are no longer new evidence.

Second, even if the fed considers the results, there is absolutely no reason to rule any differently than the Circuit court did - they don't exclude the convicts nor implicate anyone else, it's just as simple as that.

Third, Riordan knew they were worthless, and only used them to try and support a "schluo/House" claim in order to slip in other evidence for the federal court to reconsider, and Burnett explained why this was a failure as well as anyone should ever have to.

If Echols avoids the needle, it won't be through his federal HC claim.

It's kinda funny when you think about it.

The Defense themselves said six years ago that there was no way the DNA test results could exclude the convicts, and what do supporters say to that?

I was wondering can Damien still be executed without going to the Federal level or is there some kind of law that states this has to happen first before the death warrant is signed?

They have to rule on his HC filing, but there certainly doesn't have to be a hearing and I can't see any reason why there would be.

The overwhelming majority of Federal HC claims are dismissed without hearings, and Echol's is about as worthless as an HC claim can be.

Thanks I was wondering because there are 3 scheduled executions coming up in Arkansas. One for March, April and May and one of the guys has been on death row shorter than Damien has been

Where it stands now, The ASSC has to rule on Echol's challenge to Burnett's DNA ruling.

Then Riordan has to ammend his federal filing, and the state has to respond.

Then we get to scarf down Todd's best swine and laugh at the wailing supporters.

Right!  I forgot that you all believe that three teenagers somehow were so dang smart that they committed these crimes and left no DNA or took no DNA.  BRILLIANT!  Wow!  Those are some crafty teenagers!  Common sense.
